These Terms of Use govern the use of the platform,Academly under the URL https://academly.io/“ (hereinafter “website”)operated by SolaVieve Technologies GmbH, Kurfürsten Anlage 52, 69115 Heidelberg, Germany, entered in the register of companies at the District Court of Mannheim under No. HRB 734372 (hereinafter “SolaVieve“).


The platform is a website that provides information and everyday tips relating to health and wellness. The use of the platform is free of charge and is subject to the following provisions.


Any collection and processing of personal data occurs solely in line with the Data Protection Declaration.


  1. Authorised users

    1. The platform is generally freely accessible. No user registration is required. The use of the platform is only permitted for users having residence within the European Union as well as in the United Kingdom.
    2. The user needs to create an account for the website in order to get their quiz results and track their health knowledge progress. For this, the user must register with their name and email address and set a password. The email address, used as a username, and password, are the access data of the user. The access data to the website is non-transferable. The user may not share, transfer, or otherwise disclose their access data to third parties in any way.
    3. The user is also able to insert their gender, location, and birth date. This information is important for the other platforms operated by SolaVieve. It will allow for more detailed and personalized health information.
    4. The account created may also be used to access other platforms operated by SolaVieve. In the event that the account gets deleted, the user also loses access to all other platforms operated by SolaVieve.


  2. Purpose of the website
    1. The platform aims to inform the user about holistic health and wellness. For this purpose, it provides several articles, texts, interviews with health experts and practical health tips around human wellbeing, in particular to improve the user´s mental, physical, spiritual, social, environmental and economic health in daily life.

    2. Furthermore, the platform gives the user the opportunity to conduct a test of its well-being on the website https://wqtest.io/home which is operated by SolaVieve as well. This website can be reached by clicking on the links „Test Your Wellbeing“ or „Wellbeing Test“ or „Take Test“ which are contained on the platform. When the user accesses the website, the terms of use of the website must be observed.

    3. Furthermore, the platform gives the user the opportunity to conduct Virtual Coaching Sessions and Virtual Consultation on the website https://holisticly.io, which is also operated by SolaVieve. This website can be reached by clicking on the link “Improve your health through our unique combination of virtual coaching services and health tracking,” which is contained on the platform. The user must agree to and abide by the terms of use of the website when accessing and using it.

    4. The platform is not intended for commercial use by the users. They may use the information provided on the platform for private purposes only.


  3. User’s Usage Rights and Rules of Conduct
    1. The user is granted a non-exclusive and non-transferable right to use the platform in accordance with these Terms of Use. The use is spatially restricted to the territory of the European Union and United Kingdom.

    2. The copyright, names, trademarks and other intellectual property rights of SolaVieve and third parties such as the registered trademark „SOLAVIEVE“ must be observed when using the platform. The accessibility of the platform does not grant any licence or any other right to use intellectual property rights of SolaVieve or third parties.

    3. For the avoidance of doubt: the users are not entitled to publish the content provided on the platform somewhere else. In particular, the users are not entitled to reproduce, modify, distribute or to pass on the content to third parties. All rights, in particular the rights of use and exploitation under copyright law to the texts made available shall be exclusively vested in SolaVieve.

    4. Any improper use of the website is prohibited; this includes, in particular:

      • Circumventing security measures,

      • Using any system or running any application which could result in damage to systems or cause them to malfunction or instability, in particular by making any change to the physical or logical architecture of the servers or networks,

      • Integration of the entire platform or parts thereof into other web offerings, whether private or commercial, or commercial use of the platform.


  4. No warranty assumed by SolaVieve
    1. All information provided by SolaVieve on this website has been carefully checked. However, no warranty can be given for the completeness, correctness, up-to-dateness and constant availability of the website. If any advice or recommendation is given on the website, SolaVieve shall not be liable to pay compensation for any loss or damage arising from following the advice or recommendation, without prejudice to any liability arising from a contract, tort or any other provision.

    2. SolaVieve strives to ensure that the website runs smoothly. However, SolaVieve cannot guarantee that technical errors will not occur and that the website is accessible at all times.

    3. SolaVieve may, at its own discretion, modify the website or discontinue its operation in whole or in parts at any time without notice. In particular, SolaVieve has the right to expand or to limit the functionalities or to perform technical and content-related updates. There is no obligation to keep the website up to date at all times.


  5. Liability of SolaVieve
    1. SolaVieve shall not be liable for the content of third-party websites. SolaVieve therefore accepts no responsibility for the content and availability of third-party websites that can be accessed via links on the platform.

    2. SolaVieve shall be liable without limitation for intent and gross negligence. For slight negligence, Solavieve shall only be liable in the event of a breach of material contractual obligations (provisions the observance of which are essential for the due execution of the contract and on the observance of which the distributor routinely relies and may relay), whereby liability shall be limited to the typical and foreseeable damage. Otherwise, liability for negligence (with the exception of gross negligence) is excluded. This limitation of liability shall not apply in the event of strict liability, of a guarantee and for damages due to injury to life, body or health or under the Product Liability Act.

    3. The personal liability of the legal representatives, vicarious agents and employees of SolaVieve for damage caused by them through slight negligence is excluded.


  6. Final provisions
    1. SolaVieve reserves the right to make changes to these Terms of Use within reason for the user and only with future effect. The user must observe the current version of these Terms of Use.

    2. Should one or more provisions of these Terms of Use be or become void, the validity of these Terms of Use shall in no way be affected. In such a case, the invalid provision shall be replaced by a valid provision coming as close as possible to the economic purpose of the invalid provision.

    3. These Terms of Use shall be governed by the laws of the Federal Republic of Germany. The UN Convention on Contracts for the International Sale of Goods (CISG) shall not apply, However, the mandatory provisions of the state in which the user has its place of residence or place of habitual residence remain unaffected.

SolaVieve is neither willing nor obliged to participate in a dispute settlement procedure before a consumer arbitration body.
